1. Acceptance of Terms

By accessing this website or engaging our services, you agree to be bound by these Terms and Conditions and our Privacy Policy. If you do not agree with any part, please do not use our site or services.

2. Services Provided

Some Social Spice offers creative and strategic services including:

Content Creation (copy, visual, branding assets)
Social Media Management
Email Marketing (strategy, setup, copywriting)
Photography (digital delivery only)

Custom packages may be agreed upon in writing.

3. Client Responsibilities

Clients agree to:

Provide accurate, complete project information and materials in a timely manner
Respond to approvals or feedback within agreed timelines
Make payment in full by the agreed-upon due date

Failure to provide required materials or communication may delay delivery timelines.

4. Payment Terms

Payment terms will be outlined in your proposal or invoice.
Payment is processed via Payoneer.
Services will not begin until payment is received unless otherwise agreed.
Late payments may result in paused work or cancellation of future services.

For South African clients, payments may be made via EFT to our Capitec account. Full banking details will be provided on your invoice or quote. Clients are responsible for confirming transfer accuracy and referencing the correct invoice number.

5. Intellectual Property

All original content created by Some Social Spice remains our intellectual property until full payment is received.
Upon payment, clients receive a non-exclusive, royalty-free license to use the deliverables for their intended purpose.
Some Social Spice reserves the right to showcase completed work in our portfolio or marketing materials, unless a confidentiality agreement is signed.

6. Refunds and Guarantee

If, by the end of the third month of engagement (the compulsory retainer period), the Client chooses to terminate the agreement and believes that the services have not delivered desirable results, Some Social Spice will refund the full amount paid for the first month of service.

This refund:

May be requested within 30 days of the official termination date.

Does not require justification from the Client.

Will be issued in full, provided the request is made in writing and all outstanding work has been concluded or mutually released.

This guarantee applies only to Clients who have completed the full three-month engagement as per the retainer agreement.

7. Third-Party Tools & Platforms

Clients using platforms like Klaviyo or social media tools must have their own accounts and agree to those platforms’ terms of service.
Some Social Spice is not responsible for service interruptions or policy changes on third-party platforms.

8. Liability

We are not liable for:

Losses, damages, or delays resulting from client delays or third-party service failures
Outcomes that are affected by algorithmic changes or platform policies (e.g., Instagram/Facebook updates)

To the fullest extent permitted by law, Some Social Spice disclaims all warranties and liability related to your use of our services.

9. Governing Law

These Terms are governed by the laws of the Republic of South Africa. Any disputes will be handled by a court of competent jurisdiction in South Africa.

10. Changes to Terms

We may update these Terms from time to time. Please check this page periodically. Continued use of our services constitutes acceptance of any changes.
